Our Expert Answers
How do I book a consultation?
You can book a consultation by calling our office at (876) 978-6747 | (876) 473-9136, emailing us at info@wildmanandwildman.com, or using the contact form on our website. We offer both in-person and virtual (video) consultations.
What documents should I bring to my first meeting?
For your first consultation, please bring any documentation related to your legal issue. This might include contracts, titles, court documents, police reports, or written correspondence. Additionally, bring a valid form of photo identification.
What is the difference between Probate and Administration?
Probate is the legal process used when a person dies leaving a valid Will. The Court verifies the Will and authorises the Executor named in the Will to distribute the assets. Administration (or Letters of Administration) is the legal process used when a person dies without a Will (Intestate).
What happens if someone dies without a Will (Intestate)?
If a person dies intestate, their estate is distributed according to the Intestates’ Estates and Property Charges Act. The law sets a strict order of priority for beneficiaries (e.g., spouse and children, then parents, then siblings). This process often takes longer and is less flexible than distribution under a Will.
How long does the estate administration process usually take?
The timeline varies significantly, but generally obtaining the Grant (Probate or Administration) from the Court can take 6 to 18 months, depending on the complexity of the estate (e.g., number of assets, international elements, or family disputes) and current court processing times.
What is Judicial Review?
Judicial Review is the process by which the Supreme Court reviews the legality of decisions, actions, or omissions made by a public body or official. It is not an appeal on the merits of the decision, but a challenge to how the decision was reached (e.g., whether the public body acted unfairly, illegally, or irrationally).
What should I do if I am arrested?
If you are arrested, you should remain silent and immediately request to speak with your Attorney-at-Law. Do not sign any documents or make any statements to the police until you have received legal advice. Your right to legal counsel is a fundamental constitutional right.
What is the Statute of Limitations?
The Statute of Limitations is the law that establishes the maximum period after an event during which legal proceedings can be initiated. If the statutory period expires, the claim is usually considered “time-barred.” For example, the limitation period for simple contract claims in Jamaica is generally six years.
What is Alternative Dispute Resolution (ADR)?
ADR refers to methods of settling disputes outside traditional court proceedings. The most common types are Mediation (where a neutral third party assists the parties in reaching a voluntary agreement) and Arbitration (where parties agree to submit their dispute to a neutral third party whose decision is typically legally binding).
